A man has been charged with taking an alleged drug-related offence while selling unapproved erectile dysfunction medicines after buying from a pharmacy in Toronto.
He was handed a five-year jail sentence by a High Court, but his lawyer said it would be illegal to sell drugs without a prescription.
The lawyer, Paul Ludden, said that when he first arrived at the pharmacy, he didn't know what was inside.
He told the court, "I didn't know what it was. I was surprised to see it but I was really surprised and I didn't realise it.
“The drugs were being dispensed from a pharmacy and it was a large box. It was a big box. I had to take a lot of them and they were very, very expensive.
"I was very disappointed that I wasn't buying the drugs because the tablets were not approved by Health Canada."
A doctor, who requested anonymity, told the court that it was illegal to sell unapproved drugs without a prescription.
Health Canada says it has no role in the offence and that it will not be charged unless it is proven the offence is an offence under Health Canada Regulations.
When asked by court documents how he came to buy the drugs, he said, "I thought it was my health."
He was charged with trafficking unapproved drugs, selling unapproved products, possession of dangerous substances, possession of an unapproved drug, possession of unapproved drugs, selling unapproved drugs in a public place and possession of unapproved drugs without a prescription.
The judge ruled that he was the owner of the pharmacy and, as such, was not authorized to sell unapproved drugs.
He said he was only allowed to sell unapproved products and that he was buying them through the pharmacy, which was selling medicines that could be dangerous and that could be unsafe.
It is not known when the drugs Ludden was ordered to sell, but when he bought them from the pharmacy it was a three-year investigation.

The court ordered Ludden to appear in Toronto court, where he was heard to say the charges were dropped.
